Old Hat

 You just can’t make this stuff up

            The title is “old hat[1]” at this point because outrageous events keep happening in the Trump sphere.  Remember Christina Bobb?[2]  You know, one of Trump’s attorneys.  She’s the attorney that signed paperwork saying that there weren’t any more classified documents at Mar-a-Lago and represented him over the FBI taking the documents after serving a search warrant.  Then she represented Trump in District Court.  Well, she now says that she wasn’t his lawyer.[3]  I kid you not.

            Before joining the Trump Administration Bobb worked as a Marine Corp Judge Advocate.  After she left the Administration, she was a talking head for rightwing OAN at one point and now she’s with the rightwing media outlet RSBN as a reporter/commentator/talking head.  She was active in promoting the Big Lie and numerous attempts to overturn the election.  Then she lawyered for Trump and was a fav on Fox News.  Well, maybe not. 

            I’m going to hazard here that the DOJ is going to treat her like she was a lawyer and want to talk to her a LOT more about attesting to the fact that there were no more classified documents in Trump’s possession at Mar-a-Lago.  Now if it turns out that she has just been impersonating being his lawyer all this time that really isn’t going to make things better for her.  I do believe at this point that she can make a pretty good case for impersonating a lawyer.

Where are the lawyers?

            Politics Girl[4] asked a good question in one of her videos.[5]  She asked where Trump’s good lawyers were.  It’s a fair question.  The one lawyer in Florida that made Trump shell out a cool $3 mil up front to head up his legal team isn’t (so far) working the case before the Florida District Court of Aileen Cannon.[6]  So far he’s a stealth lawyer. The other lawyers don’t make up what would normally be called a powerhouse team.[7]  Why doesn’t the former President have one of those huge Ivy League firms with hundreds of lawyers at their disposal representing him? Perhaps he can’t afford them.

            Some of the answer may reside in the reidentified acronym MAGA to mean Make Attorneys Get Attorneys.  A number of Trump’s previous lawyers have had charges filed against them with various Bar Associations to be sanctioned for their worthless filings in court.  Sidney Powell had one of my favorite excuses when she proffered that “No reasonable person would conclude that the statements were truly statements of fact,” in a court filing over one of her many fantasyland allegations.[8] 

            What will Trump do next?

Witch Hunt

Got the goods

            New York Attorney General Letitia James has filed a civil suit against all the various Trump enterprises.[1]  It’s quite the read.  If it were a book Trump Republicans would be banning it.  The filing is a culmination of a years-long effort.  The case is going to go on for years more.

What an undertaking it has been, too.  You know there’s a point in the movie “Erin Brockovich” where the lawyer realizes that they need the resources of a bigger firm because of the size of their case.  Same thing happened in the Better Call Saul franchise where Jimmy has to hook up with a bigger outfit.  I can’t imagine the team that AG James put together to handle this.  The finances are a quagmire in a labyrinth hidden in a fog.

It's no witch hunt either.[2]  She’s got the goods.  In great detail.  I see why Trump offered to settle.  He, along with his family, are going to spend millions fighting this.  Trump may be a Chatty Cathy[3] in public but he’s 5th Amendment pleading mob boss magician in court.[4]

From FindLaw:

“Finally, it's important to note that the protections you have in criminal prosecutions when taking the fifth do not apply in a civil case. A jury is free to make an adverse inference if you plead the fifth in a civil trial. For example, if you are suing another driver after being injured in a car crash, and you refuse to answer whether you had been drinking, the jury is free to assume you refuse to answer because you had, in fact, been drinking prior to getting behind the wheel.”

            One of my favorite parts is where Trump lied about the size of his penthouse.  It’s approximately 11,000 sq feet in size.  It takes up 3 entire floors.  Ever the braggart, Trump claimed in legal filings that it was 30,000 sq ft in size and placed an inflated value on top of that.  He lied on top of the lie. 

It’s just so Trumpian.

            The case made against Trump and Company provides some insight as to why he ran the government the way he did.  It was how he did business.  He lied.  He lied often.  He lied to make money.  It worked.  At page 74, paragraph 260 in the filing there was an admonishment to not put communications in writing.  His tax attorney told people to avoid email and communicate via phone.  They wanted to avoid leaving a paper trail as much as possible. 

Trump used different schemes, like the Brand Premium scheme, the Fixed Assets scheme and Membership Deposit Scheme, to “adjust” values more to their liking regardless of legality.[5]

            One part of the document really jumped out to me.  One of Trump’s lawyers was advised the following regarding a scheme that they had used in land donated for tax purposes:[6]

In January 2015, the donation of the easement to the Palos Verdes Peninsula Land Conservancy was publicly disclosed. Ms. Dillion advised against the press conference for a host of reasons, including a desire to avoid drawing undue scrutiny to the transaction. On January 14, 2015, she wrote to an in-house lawyer at the Trump Organization: “Remind him that the larger the value and the more he makes of it, then he is telling the world how large a tax deduction he is taking for it. In this case, this is tantamount to the US taxpayers paying Donald Trump to keep his driving range and use it for exactly what he is already using it for - and some could argue that as long as he is operating the golf course, he would continue to keep the driving range - effectively, the US taxpayers are paying him to do what he would already do anyway, and perhaps this isn’t the best use of taxpayer dollars. Bottom line - the more publicity this gets, the more we invite scrutiny. This may cause renewed interest in the issue.”

            What did Trump do?  He held a press conference!  He doesn’t seem to be capable of keeping his mouth shut except for when he’s under oath.  Then he has trouble remembering details or pleads the 5th like a criminal.

            The larger issue is that when the government is defrauded, or the tax system manipulated it is taxpayers that pick up the cost.  Trump isn’t the only billionaire doing this.  Corporations do it as well.  They create money out of thin air with all these complicated financial tools that have been created over the years for the sole purpose of taking care of the wealthy.

            Trump loves to create his own wealth out of the thin air allowed by whim.  In 2013 when he was bidding on the Buffalo Bills football team, even though his own financial statement said that he was worth $5.1 billion dollars he claimed that he was worth $8 billion.[7] 

He is ever Trump.

Surprise! Surprise! Surprise!

            Aaaaannnd the search warrant executed by the FBI at Mar a Lago turned up tax information that evidently hadn’t been turned over when subpoenaed by the New York AG.[8]  It also seemed surprising to me when key players were listed in the filing as defendants Ivanka Trump wasn’t mentioned in the paragraph referenced with those committing long term fraudulent conduct were listed.[9]  Not a big deal.  Just seemed like an anomaly.  She was mentioned throughout the filing and was listed as being a defendant at the beginning. She was also mentioned in the “Prayer for Relief.”[10]

            The first Cause of Action (charge) starts at page 200 and goes on with a total of 7 Causes of Action ending at page 212.  It’s quite a list.  

It isn’t pretty.

Without joy

            None of this will be settled by 2024 let alone 2022.  There will be mountains of paperwork filed.  This is a civil case.  Even though AG James has made criminal referrals that doesn’t mean they will happen.  There are just so many resources available and cases like this tie up LOTs of lawyers, time and money.

            Perhaps more than the monetary judgement that AG James is looking for she is asking for the Trump Organization to cease doing business on its own.  She has asked for the Trump family to have their licenses to do business in New York pulled for 5 years.  One corrupt man can drag down a lot of people.

            You know, for me at least, there really isn’t any joy derived from a filing like this.  Trump was President of the United States, after all.  I suppose it was inevitable that this would eventually happen after a couple of hundred years, along with a President not accepting that he lost, having the peaceful transfer interrupted, and a coup attempt.  We are on the cusp of losing all that has been gained through generations of blood sweat and toil. 

It’s sad.

B sexual

            This is going to amble a bit before I get to talking about gender and Gender Sexuality Awareness (GSA), Critical Race Theory and public education.  They’re all connected.  At some point in this post, I’m going to come out of the closet so to speak.  Exciting, isn’t it?

A couple of years prior to the 8th grade I discovered that my mom had an adult medical book that covered a lot of ground, including reproductive systems along with some psychology.  It’s possible that she was trying to find out if I was hers.  My parents had not quite realized how far ahead of my age I was reading.  I was quite the authority.

            Then in the 8th grade, (Yes, I can still remember that far can you believe it?) I was tasked with running the projector for a film presentation to some PTA women concerning a sex education video that they were previewing.  In Kansas.  The teacher picked me because she said that I was mature for my age.  I don’t know about that; I think it may have been more about my knowing how to run the film projector and she didn’t.  While it was an enlightening film, it wasn’t salacious and I didn’t learn anything new.  The students did not get to see the film.  It’s possible that was my fault.

My face may not have been a mask for my true emotions.

Birds and bees

            What I have observed and learned in the years since is that conservatives in general are fixated on sex and not in a good way.  It wasn’t to be talked about in the open anywhere and they weren’t really big on young adults knowing about what was going on in regard to sex.  So, there was a lot of on-the-job training on our part.  A lot of young people learned about reproduction the hard way.  There were a lot of unplanned pregnancies back then for young and old alike.  This was the era when birth control pills (oral contraceptives) were just getting started.[1]  They weren’t readily available to teenage girls.  We depended primarily on condoms.  Or not, as the case often was. 

            The religious crowds advocated abstinence.  They still do.  Abstention works as well today as it ever did.  It’s marginally better than the rhythm method. 

Maybe not.

The more things change…

            Conservatives opposed sex education then.  They oppose sex education now.  They opposed the availability of contraception then.  They oppose the availability of contraception now.  Same for abortion.  Same for gays.  Back then two guys holding hands in public, or OMG kissing, would have been assaulted.  Interracial dating and marriage were also socially frowned upon.  Gay marriage wasn’t on the horizon let alone the agenda.  During those years gays were also accused of recruiting young people into their lifestyle.

Interracial marriage didn’t become legal until 1967.[2]  Since a woman’s right to control her own body has been virtually abolished, the activist Trump Supremes can now revisit rulings allowing gay marriage, contraception, interracial marriage, separation of church and state, etc.[3]  (Thanks conservatives!)

            Fast forward to today and Trump Party Conservatives are once again trying to marginalize people of color.  They use the same racist language against brown immigrants that they used against “colored people” in the past.  They are dangerous!  They need to be kept in their place.  Teaching Critical Race Theory (CRT) makes white kids feel bad, so we need to stop teaching it to kids even though it wasn’t being taught to kids.[4] 

            This brings us to public education and the long running quest of conservatives to defund public education.  Public education is dangerous to them.  Trump loves the poorly educated demographic.[5]  So now in addition to demonizing CRT they are adding GSA to their list of evils.  It’s sex education so naturally they oppose it. 

Now, just to be clear since Trump Conservatives would want to say that I’m advocating showing sexually explicit material to bitty children, I’m NOT.  Education needs to be age appropriate. 

Trump Republican Conservatives don’t celebrate our differences or uniqueness as human beings.  People that think or believe differently than them just need to be stamped out.

            But now according to conservatives it isn’t just gays that are recruiting children, teachers and educational institutions are doing it as well.  Only they don’t say teach or taught.  Teachers are “grooming” and “brainwashing” kids.  Pedophiles are everywhere.  Books that present different lifestyles other than what they deem normal are bad.  The kind of people in Kansas that banned the kid’s book “Charlotte’s Web” for being blasphemous in 2006 have gone mainstream.[6]  There isn’t anything too outrageous for these people to sell to their true believers; their election deniers.  If anybody is brainwashing or indoctrinating kids it’s going to be them, by God!

Just like in the good ole days.

Gender identity.

            Back in the day, people had a hard time accepting that some people are gay.  Times were simpler then.  We had homosexuals, lesbians and bisexuals.  Then an alphabet soup of letters was added:  LGBTQIA+.[7]  If that wasn’t confusing enough now we have cisgender, binary and non-binary.  Different letters, different pronouns.  Everybody gets a letter except for straight people.  No S. 

I can’t begin to keep it all straight.  My wife has to explain and reexplain things to me on a regular basis.  I keep it simple.  God created man and woman and everything in between.  I’m quite certain that I have probably offended lots of letters here and offer my sincere apologies because it’s not intentional. 

But being a man of a certain age undergoing various medical treatments for cancer and other things I have reached the point where I’m byesexual.  I think that a lot of oldsters are in this category along with some younger ones.  Do we get a letter now?  No, we don’t.  Straights either.  We don’t need one.  We were never stigmatized or marginalized for being what we are.  We aren’t discriminated against.  No moron groups came up with ways to “fix” us with some abominable form of conversion therapy.[8]  We don’t need fixed.

Neither do LGBTQIA+ people.

Young people

            It’s hard enough for young people to figure out their way through life without having people giving them a hard time when they are figuring out their identity in life and I’m not just talking about their sexual identity either.  They don’t need any adults or peers laying guilt trips on them for who they believe they are.  Perhaps they’re just figuring it out.  They need to be able to do that in peace without fear of punishment or being bullied.  The human race is a wonderfully diverse race.

Let’s celebrate that.
